Öcalan’s lawyer: “We can only assume he is alive”

Öcalan was last contacted by his brother on September 22, 2016 and hasn’t been heard from since

The isolation imposed upon Abdullah Öcalan has continued unabated for a year. It has been 2 months since Öcalan’s lawyers prepared a report on July 27, and during this time there has been no news from the Imrali Island regarding Öcalan. Öcalan's last contact was with his brother in September 22, 2016.

NO POSITIVE DEVELOPMENTS

Lawyer Bilmez said they wanted to let the public understand the isolation with the report they prepared in July 27, and that there have been no positive developments yet. Bilmez said they appealed to the Bursa Chief Public Prosecutor’s Office twice every week for the weekly visitation and once a week for the family visits, and that all of the appeals have been rejected.

Bilmez mentioned the completely illegal executive judge decree issued after July 15 and continued: “When we announced the report, we explicitly stated that we are pressing charges against the prosecutors who prevent our visit to the island. We have also appealed with the Supreme Council of Judges and Public Prosecutors (HSYK) and that is underway but there are no developments yet.

The prosecutor’s office is clearly committing a crime because no lawyer has been to the island since July 27, 2011. Not for Mr. Öcalan, or for other prisoners. Shortly after we announced the report, the prosecutor was replaced, but nothing changed and this prosecutor also rejects our appeals. So we are preparing to press charges against him as well.”

NORMALLY NO PERMIT IS NEEDED

Bilmez stressed that normally no permit is needed from the prosecutor’s office for lawyers to visit their clients, but the isolation system in Imrali has been constructed to be so from the beginning, and explained the bias: “Because it is an island prison, it is not possible for us to physically travel there with our own means. We were told to appeal with the Bursa Chief Public Prosecutor’s Office, and we have to appeal to visit the island.

Normally, lawyers who would visit their clients would go to the prison, hand in their ID at the gate and have the visit. It doesn’t matter if the client is convicted or in remand. We make these appeals because we have to, but the prosecutor’s office rejects us as if we are demanding a permit.”

NO CHANNEL OF COMMUNICATION

Bilmez said the family visit appeal for the Eid is the one rejected most recently, and stressed that this is a severe situation not only in the sense of defense, but in regards to humane treatment as well. Lawyer Ibrahim Bilmez stated that there has been no contact since Mehmet Öcalan’s visit on September 22, 2016 and reiterated that no letters or telegrams have come out of Imrali, and telephone rights of all prisoners there have been revoked.

WE CAN ONLY ASSUME HE IS ALIVE

Bilmez said their appeals regarding Öcalan’s health have also been rejected and continued: “We tried to meet with the prosecutor regarding Mr. Öcalan’s health as well. We asked for a copy of his chart there, because Mr. Öcalan has existing conditions that we are aware of, and we are concerned because we haven’t seen him. But these appeals were also rejected. We have no information on the fate of the letters and telegrams we sent. We don’t know if he received them or not. We can only assume our clients are there.

IT’S A MANIPULATION THAT THERE ARE NO ONGOING LAWSUITS

Lawyer Bilmez said they deliberately included the ongoing lawsuits against Abdullah Öcalan in the report and continued: “The lawsuits we filed, the charges we pressed are also in the report. In the Constitutional Court in Turkey and in the European Court of Human Rights. We deliberately included these, because occasionally the Ministry of Justice or other government officials use manipulation and claim that our clients have no ongoing lawsuits and thus don’t need to meet with their lawyers. But that does not reflect the truth, our clients have several lawsuits.

According to Turkish law, convicts don’t need to have ongoing lawsuits to be able to meet with their lawyers. Because lawyers also have the right to monitor, inspect and control the execution of the punishment. Because convicts can’t be left alone after they are put behind walls. The effects of the punishment on the person need to be monitored. So, that is a duty of the lawyer as well, but we are prevented from this duty too.”

747th appeal to meet with Öcalan since 2011

Kurdish leader Abdullah Öcalan’s lawyer have appealed for the 747th time to meet with their client on İmralı Island.

Lawyers for Abdullah Öcalan, Ebru Günay, Mazlum Dinç and Muharrem Şahin have filed another appeal to Bursa Public Prosecutor’s Office in order to meet with their client in İmralı Island Prison.

This is the 747th appeal submitted by the lawyers for a meeting with Öcalan since 27 July 2011. All the appeals have been rejected so far on grounds of “weather conditions”, “malfunctioning coaster”, “coaster reparations”, and “state of emergency” since 2016.

Lawyers file 753rd appeal to meet with Öcalan since 2011

Abdullah Öcalan's lawyers filed an application with the Bursa Prosecutor's Office for the 753rd time to visit their client. Since July 27, 2011, each application has been rejected.

Kurdish leader Abdullah Öcalan's lawyers İbrahim Bilmez, Faik Özgür Erol and Fuat Coşacak today filed an appeal with the Bursa Prosecutor's Office for the 753rd time to visit their client.

Previous appeals by the Öcalan’s lawyers have been rejected regularly by the Bursa Chief Public Prosecutor’s Office on grounds of “Restrictions against convicts” listed in the Execution of Penalties and Security Measures Act No.5275.

The appeals have been rejected to date, citing excuses like “bad weather”, “broken boat”, “boat repairs” and “State of Emergency”.

Abdullah Öcalan has been denied any legal aid for more than six and a half years. He is subject to total isolation on the prison island of Imrali in the Sea of Marmara.

Human Rights Association: Öcalan’s situation unacceptable

The Human Rights Association (IHD) held its General Assembly in Istanbul.

IHD Co-Chairs Eren Keskin and Öztürk Türkdoğan opened the General Assembly which saw the participation of many people, included HDP Istanbul deputy Hüda Kaya, Education and Science Workers Union (Eğitim-Sen), Peace Mothers and relatives of missing people.

The room where the Assembly took place was decorated with a banner saying “No to violence, war, and OHAL! Peace for human rights now!”.

In her opening speech, IHD Istanbul Branch Chair, Gülseren Yoleri, said that as a result of the 32 years of struggle, as human rights defenders, they had to struggle under coup conditions, State of Emergency (OHAL) and violations of any kind.

Yoleri reminded that last year the slogan of the General Assembly was “We were born under martial law and we continue in OHAL”. She underlined that the IHD has certainly “played an important role against human rights violations since its foundation”.

Türkdoğan: We fight for human rights

IHD Co-Chair Öztürk Türkdoğan stated that the IHD is fighting for human rights because it is against injustice.

Türkdoğan visited the HDP’s jailed presidential candidate Selahattin Demirtaş. He said: “Today I visited Presidential candidate Selahattin Demirtaş. I bring you his greetings. When he was a candidate, in the previous presidential election, he visited our association. This time, unfortunately, he cannot come. This time we have to visit him. This is one of the typical examples of injustice in Turkey”.

The IHD co-chair continued: “Unfortunately Demirtaş is prisoner, yet but others are doing what they want freely. This is unacceptable. This is black propaganda. Demirtaş is a human rights defender who has not been involved in any kind violence throughout his all life. He is a member of our association and I hope to see him soon free retaking his place among us at our next General Assembly”.

Referring to Abdullah Öcalan, Türkdoğan said: “Let's leave the political identity of Abdullah Öcalan on one side. He is a human being, he has a personality, and he has prisoner rights. Why do you not raise a voice heard for him?"

Türkdoğan said that Öcalan is an unacceptable situation: “It does not happen that we don’t have news of prisoners for over month. Therefore this situation must end. The regime imposed on Imrali prison has actually spread throughout Turkey with the State of Emergency decrees”.

Keskin: These elections are very important

IHD co-chairman Eren Keskin said in her speech that the current situation is very complicated.

She said: “As defenders of human rights, we have always seen these things. There is a visible State with its ministers and prime minister, and there is an invisible real State. We can call this hidden State with a lot of different names. Deep state, special war zone or counter-guerrilla state, whatever. For the first time, the deep state has been seeking a deal with the visible state, in the past 18 months. For the first time, the people went to reconcile with a party that had such a high power. Let's not forget the state. Erdogan made us forget the state. This is wrong. Today we are living the pressure which is product of this compromise. But it will pass. This compromise seems to have started to break up. These elections are really important”.

HDP Istanbul deputy Hüda Kaya said: “As HDP, in the Parliament, we have repeatedly investigated the dark events happening, including Kobanê. It is not difficult to expose the dark face of the deep state. We are trying to struggle for peace, freedom and equality wherever we live”.

After the presentation of several reports, the new executive department was elected; Gülseren Yoleri, Leman Yurtsever, Semiray Yılmaz, Hatice Kalpaklı, Hanım Tosun, Begali Kurnaz and Hüseyin Aygün. Hatice Kokmaz, Ali Gök and Zeynep Yildiz were selected as members of the Supervisory Board.

The Turkish state continues denying access to Abdullah Öcalan who is held in aggravated isolation.

Abdullah Öcalan’s lawyers Rezan Sarıca, Fuat Coşacak and Nevroz Uysal filed an appeal with the Bursa Prosecutor's Office for the 758th time to visit their client in İmralı Island Prison.

The appeal has been rejected on grounds of “Restrictions against convicts” listed in the Execution of Penalties and Security Measures Act No.5275.

Appeals by the Öcalan’s lawyers have been rejected regularly since 27 July 2011 by the Bursa Chief Public Prosecutor’s Office, citing excuses like “bad weather”, “broken boat”, “boat repairs” and “State of Emergency”.

Lawyers submit the 763rd appeal to visit Öcalan

Abdullah Öcalan’s lawyers appealed to the Bursa Chief Public Prosecutor’s Office to visit their client.

Families’ appeal to visit İmralı and Ocalan rejected

The appeals to the Bursa Chief Public Prosecutor’s Office by families of Abdullah Öcalan and 3 other prisoners in Imrali to visit their relatives have been rejected

The appeal by Abdullah Öcalan’s brother Mehmet Öcalan, sister Fatma Öcalan and titular Mazlum Dinc submitted to the Bursa Chief Public Prosecutor’s Office yesterday through their lawyers to visit the Imrali island has been rejected.

Imrali prisoners Hamili Yildirim’s brother Polat Yildirim, Omer Hayri Konar’s brother Ali Konar and Veysel Aktas’s sister Sabiha Aslan’s appeals were similarly rejected.

The appeals were rejected by the prosecutor’s office on grounds of “restrictions against convicts” in the Execution of Sentences and Security Measures Act No.5275.

Lawyers 765th appeal to visit Öcalan

Abdullah Öcalan’s lawyers have appealed to the Bursa Chief Public Prosecutor’s Office for the 765th time to visit their client.

Abdullah Öcalan’s lawyers Cengiz Yurekli, Mazlum Dinc and Sinan Zincir appealed to the Bursa Chief Public Prosecutor’s Office for the 765th time to visit their client this morning, 210 November 2018.

The previous 764 appeals by the lawyers since July 27, 2011 have been rejected with various excuses.

Families of Abdullah Öcalan, and the other 3 prisoners on Imrali, appealed to the Bursa Chief Public Prosecutor’s Office to visit Imrali

Meanwhile, the lawyers’ 766th appeal to visit was rejected.

Abdullah Öcalan remains imprisoned in the Imrali Prison Öcalan’s brother Mehmet Ocalan, sister Fatma Ocalan and tutelar Mazlum Dinc appealed through their lawyers to the Bursa Chief Public Prosecutor’s Office to visit Imrali.

Imrali prisoner Hamili Yildirim’s brother Polat Yildirim, Omer Hayri Konar’s brother Ali Konar and Veysel Aktas’s sister Sabiha Aslan appealed through their lawyers to the prosecutor’s office to visit their relatives.

LAWYERS REJECTED

Family of Öcalan denied visit to İmralı

The family of Abdullah Öcalan had their application rejected once again

Abdullah Öcalan's brother, Mehmet Öcalan, his older sister Fatma Öcalan and Mazlum Dinç filed an application to Bursa Public Prosecutor's Office to visit their relative.

The application was rejected once again.

Prisoners Hamili Yıldırım's brother, Polat Yıldırım, Ömer Hayri Konar's brother, Ali Konar and Veysel Aktaş's sister, Sabiha Aslan also filed a request to visit their relatives but had their petition rejected.

The prosecutor's office cited restrictions imposed on convicts under “Law no. 5275 on the Execution of Criminal and Security Measures” for the rejection.

Omer Ocalan appeals to visit Imrali

Peoples’ Democratic Party (HDP) Urfa MP Omer Ocalan appealed to the Justice Ministry to meet with the isolated Kurdish his uncle Abdullah Ocalan

“THE PROCESS IS AT CRITICAL CONDITION”

Omer Ocalan stated the following in his appeal:

“My uncle Mr. Abdullah Ocalan, who is currently held in the Imrali High Security Prison Type F, hasn’t been allowed to meet with his lawyers since July 27, 2011 and with his family since September 11, 2016.

Since July 21, 2016, the Bursa Executive Court No.1 has cited the State of Emergency declared in the country to completely cut off all exercise of his fundamental rights.

Any and all means of communication including letters, fax messages or telephone calls have been banned indefinitely and without exception. This goes against fundamental principles of law, the equality principle, the ban against discrimination and fundamental prisoner’s rights issues like the right to a lawyer and legal aid.

Hunger strikes have been started in prisons demanding communication channels be opened with Mr. Ocalan, and this process has reached a critical stage. For all these reasons, as his family members, we demand and request that channels of communication with Abdullah Ocalan be opened as soon as possible.”

KCK statement on Imralı meeting

“The “Let’s break isolation and tear down fascism” campaign launched by the Kurdistan Freedom Movement continues spreading to all areas. While hundreds of prisoners are engaged in a hunger strike action with great resolve, the hunger strikes started by our people in four parts of Kurdistan and abroad, as well as demonstrations, protests and other actions are expanding our freedom resistance.

In such an environment, the fascist AKP-MHP government which has executed a heavy repression and isolation for years, had Mehmet Öcalan go to Imralı and have a meeting with his brother Abdullah Öcalan on January 12, Saturday, as was reported by the media.

First of all, it is clear that what enabled this meeting with Öcalan is the resistance campaign developed by our people. In this sense, the “Let’s break isolation and tear down fascism” campaign that developed under the leadership of Leyla Güven, has achieved its first serious success. On this basis, we congratulate our resisting people and friends, and wish them further successes.

However, the meeting held in Imralı on January 12 does not mean the ending of the isolation. Thus, the aggravated fascist repression and isolation imposed upon Leader Abdullah Öcalan in Imralı is continuing. For this reason, the “Let’s break isolation and tear down fascism” campaign we started as the Kurdish People and Freedom Movement, also continues. The resisting comrades, our people and friends should not interpret it wrongly. The January 12 meeting was an attempt made as part of the special psychological war developed by the AKP-MHP government to sabotage the “Let’s break isolation and tear down fascism” campaign. The fact that the meeting was held on Saturday, a holiday day, makes this truth apparent.

It is obvious that in order to break and frustrate our resistance, the colonialist-genocidal AKP-MHP government resorts to such a special war trick due to the problems it experienced in the face of our developing initiative of freedom and resistance. However, we know very well the atrocities and tricks of the fascist war. For this reason, we will not be deceived by the special war tricks and we will enhance our actions of resistance until the walls of Imralı are torn down, the isolation ends and Leader Abdullah Öcalan attains conditions of living and working freely. All our people, friends and the public opinion should know this truth this way. Our resistance initiative will break the isolation, tear down fascism and on this basis achieve a free Kurdistan and democratic Turkey.”

International Imralı Peace Delegation to visit Turkey

Before their talks in Ankara, two members of the delegation, Ögmundur Jónasson and Connor Hayes, will also visit the activists participating in a hunger strike in Strasbourg, France

The International Imralı Peace Delegation, consisting of academics and activists from different countries will hold talks in Turkey and North Kurdistan on February 11-16.

The delegation consisting of Icelandic historian Ögmundur Jónasson, British unionist Manuel Cortes, Argentinean economist and human rights activist Beverly Ann Keene, British jurist Paul Scholey, British actress Maxine Peake, US philosophy student Connor Hayes, British trade unionist Tony Burke, British writer John Hunt, British photograph artist and director Jonathan Spaull, is set to hold talks in Turkey and North Kurdistan between February 11-16.

The delegation, which has applied to meet with Abdullah Ocalan in Imrali and officials of the Turkish Ministry of Justice, will start their talks with a meeting on 12 February with Pervin Buldan, the co-chair of the Peoples’ Democratic Party (HDP). The delegation will hold a press conference at the HDP headquarters, and will meet with officials of the Human Rights Association (IHD), the Human Rights Foundation of Turkey (TIHV) and Public Workers Unions on the same day.

The delegation will be moving to Amed (Diyarbakır) on February 13, and meet with Leyla Guven, who is on a hunger strike for 93 days. The delegation will then meet with representatives of civil society organizations in Amed.

On February 14, the delegation will meet with representatives of the Democratic Society Congress (DTK), Democratic Regions Party (DBP) and Mothers of Peace.

The delegation will then travel to Istanbul, set to hold a joint press conference with the lawyers at the Asrin Law Office.

Before their talks in Ankara, two members of the delegation, Ögmundur Jónasson and Connor Hayes, will also visit the activists participating in a hunger strike in Strasbourg, France.

Families’ appeal to visit Imrali rejected again

Families of Ocalan and 3 prisoners in the Imrali Island appealed again to visit their relatives but were rejected

Abdullah Ocalan’s brother Mehmet Ocalan, sister Fatma Ocalan and tutelar Mazlum Dinc appealed to the Bursa Chief Public Prosecutor’s Office through their lawyers to visit the prison but were rejected.

Family members of other Imrali prisoners, Hamili Yildirim’s brother Polat Yildirim, Omer Hayri Konar’s brother Ali Konar and Veysel Aktas’s sister Sabiha Aslan, also appealed but were also rejected.

Internationalists:
Freedom for Öcalan is our struggle


In the 20th anniversary of the conspiracy against Abdullah Öcalan, a long march from three different places was launched to support the hunger strikes led by Leyla Güven

The Luxembourg branch of the march includes about 100 internationalists from Germany, Sweden, Finland, Spain, Italy, Norway, the Netherlands and many more.

The march, that reached its third day, has been joined by internationalists who have also joined previous marches.

German Internationalist Alex Dickmann had previously participated in two long marches from Luxembourg to Strasbourg. “Of course, it's hard for me - said Alex - But there are challenges to be faced. Difficulties don't matter when you are walking for human ideals. It gives me strength to walk for such beautiful purposes and to walk with so many precious people from different geographies. I can't think of my health problems right now.”

As in the previous two years, this year, he is wearing the badge of Abdullah Öcalan.

Alex attended this year's march with his wife, Maren.

We cannot accept isolation against Öcalan

When I asked Alex about his views on the march he joined for the third time, he replied: “The only alternative project against the developing capitalist system in the West is Mr Öcalan's project. This project showed how, we in the west, can build a better life. A person with such beautiful projects has been in prison for 20 years. I'm here against isolation and inhuman treatment. There is a revolution going on and its led by Kurds. I'm walking to add to my voice. Anyone who lives in Europe, who says he is human, should contribute to this revolution. Which is why I invite everyone to amplify the voice from the Middle East.”

Why are you here?

Maren, who attended the march for the first time, tells why this year she decided to join as well: “Alex had joined two marches before that. This year I wanted to join. I would like to state that I am very happy to be on this march with my husband. We should not be asked why we are here. The question should be, why other people are not here? Yes, so many people live in Europe. We should ask why these people are silent about the policies against Öcalan and the massacres against the Kurds and why they are not involved in this action. We are talking about an atrocity here and we should take on our responsibility and act to stop this atrocity. We are here to fulfill our duties.”

We are happy to be here again

Naomi Ferreira is 21 years old and lives in Galicia, an autonomous region of Spain.

Naomi, who joined the march last year, says that she has had the chance to see her friends this year and she is very happy to have joined the march for the second time.

Naomi said that she had a very good impression on the long march last year and that she had the opportunity to know the Kurdish people and the Kurdish movement. She said that she has taken her commitment to a higher level and is more actively in solidarity with the Kurds.

Öcalan’s ideas are important for everyone

Naomi said that she knows how important Abdullah Öcalan is for Kurdistan and the Middle East peace. “I find Mr. Öcalan's ideas and perspectives very important not only for the Kurds but also for all the progressive humanity. I like Öcalan's approach to women. Again, I highly appreciate the effort of Öcalan to create a free human being. Therefore, I believe that Mr. Öcalan should be freed as soon as possible.”

We support the hunger strikers

Naomi recalled the hunger strikes led by Leyla Güven. “We should take our responsibility and somehow that’s why we have joined this march. There are people who have gone on hunger strike demanding the end of isolation. In a sense, I am here because I see this march as a solidarity action with these people, to raise their voices, and not leaving them alone in their struggle against this barbarity.”
